As long as you reported it at the airport, they're responsible for damage. The DOT "reminded" the airlines a couple of years ago that they don't have the right to decline or disclaim this responsibility (up to DOT limits of, I think, $3500 for a domestic itinerary and about $1550 for an international itinerary).
B&R's warranty is great. I sent in a soft-side bag that had a frayed seam, effectively creating a hole. I expected my bag to be returned with a patch.
I got a brand-new bag instead. If B&R can't repair it, they'll replace it. The only thing I had to pay was for one-way shipment of the bag to a B&R repair center. (Return shipping was free).
