Thank you. "Controllable safety" issue sounds like EU261 should apply.
Generally speaking, EU /E 261 should include any kind of maintenance issue since it's the responsibility of the carrier to have backup planes.
The logic is something along the lines of that plane breakdowns are expected to happen so carriers need to plan to have other aircrafts available.
