Logically the resort fee should include the pool, but this wasn't mentioned by the OP in the listing of water, coffee, etc., so legally it's dubious although IANAL.

Nevertheless, I'd expect compensation (or a significant customer service gesture) for the pool situation and the hotel's failure to notify people in advance about this. I also would have been pestering staff for water from the beginning.
