OP has not provided a location with Orange County, which is a large place (6th largest state if it were a state!). So, without exact information, e.g. location & name of property, it's a bit hard to provide a definitive answer.
But, what happens elsewhere is irrelevant. What matters is whether there is a local per night fee imposed by the jurisdiction. Typically called something such as "tourism fee" or something similar. Alternatively, some jurisdictions impose a per night fee to cover the cost of a specific facility such as a convention center.
In those cases, the t&c of the program make it very clear that the fee is not included. If the property chooses to absorb the cost, that is an individualized decision of the property.
These are becoming more and more common. No local consequences as local taxpayers rarely absorb the fees, businesses just include it in overhead, and for leisure travelers, it is typically small in the US.
