I've just read the rental terms for Australia
https://images.hertz.com/pdfs/RT_FULL_AU_EN.pdf and I don't think this gives the the right to charge the processing fee for passing on notices of fines. It is badly written so it is difficult to tell. It says "We will work with authorites to pass on notices of fines and parking charges to you, and also charge you the Processing Fee." What exactly does this mean? Is it enforceable?
Seems pretty clear to me:
1. "We will work with authorites to pass on notices of fines and parking charges to you" = if we receive a notice or fine of parking charge from a government agency, we'll pass that on to you.
2. "and also charge you the Processing Fee" = We'll charge you a processing fee for doing item 1 above.
In another part of the agreement, it states "We will pass on notices for the fines and parking charges to you, and also charge a Processing Fee (unless you have purchased SuperCover)."
In yet another, it defines Processing Fee: "The amount payable for administrative functions Hertz undertakes including the payment of, or handling of any claim for, any charges and penalties, such as processing of traffic fines, penalties and toll way use (where Toll Cover is not purchased)."
