On the website they say, "Members using commuter benefits cards always ride in vehicles which can seat six or more," and "Via also offers a private ride option when available. Commuter benefits users are excluded from any private ride options." The wording doesn't make it clear how they decide who is/isn't a "commuter benefits" user. The "right" way to do it would probably be to track "tainted" credits using a FIFO model. But I wouldn't be surprised if they did something simpler (which could be good or bad for the user, depending on which lazy route they took). If you have used a benefits card with your Via account, do you see the private ride option when you do an intra-Manhattan ride? If not, try deleting the benefits card from your payment methods and see if the private rides show up then.
