I've been dealing with a lot of sloppy German legal writing today, so don't feel bad on a Sunday whether or not doing a confession.
It's legal to drive with an invalid license if also driving with a valid license; and that's why it's said that it's a criminal offense to drive without a valid license.

It is, once again, an issue of when the license is valid and/or when it is not valid.
The Vienna Convention is not the only agreement out there allowing for licenses to be used in a jurisdiction other than the one that issued it, even as it's the most common one when it comes to use of licenses for driving in a jurisdiction beyond just that of the issuer of the license.
