You could make the same case for not wearing seat belts in a car. It's the law.
What is it about FAR 121.311 that you don't understand? It's Federal law that passengers must be seated with seat belts fastened while on active taxiways.
Your solution is that airlines should break federal law? That's somehow common sense to you?
