If you have delayed luggage and choose not to fight to get compensated, that is your choice , however the airline is liable regardless of where the flight is going to

There is more chance that the impact to a passenger will be minimal when returning home

In the UK at least it would be pretty straightforward to initiate a claim on money claim online if the airline tried to avoid reimbusing costs incurred due to the delay
