It is "not easy" because the judge has to hit the taxpayers with a huge bill for the government's misbehavior. Almost every factor for a large award of fees in this case is present. Will it be $3.5 million? 2 million? 1.5 million? We'll find out soon enough. Certainly the award should exceed lodestar rates for a case like this.
