I think it's worthwhile putting in a claim for this. At least to see LX's response to the matter (whether they will pursue the invalid ticket argument, and then perhaps how the EU authorities will rule on that if appealed).
See now if Swiss hires a Lawyer to fight this then they are really stupid. A day in small claims court and preparation will easily cost Swiss £2000 in Lawyer fees and the penalty for the same is 1/4th that. Logically I would expect them to pay and be done with it. I just paid £600 for 5 minutes work at SCC to a Lawyer. I can expect Swiss Lawyers to charge 3-4 times that.
Also in a SCC I doubt the judge would go into the details. Person was flown to Europe on a valid ticket.
