The over 40 is actually over 37....that's due to what's commonly called "6c" status....ie 20 year Federal LE Retirement.
One has to be in the system by 37 so they can retire by 57. Military and prior 6c service is exempt....
Not negative, positive. I'm pretty familiar with the OPM standards and what I stated fundamentally aligns with what you state above -- except for your first sentence -- with the exception being I left out military and 6cs when I should not have. Exemptions don't get rid of age maximums -- it just allows for exemptions around the age maximums.
