DOT has ruled otherwise in previous error fare cases. Only passengers with tickets, not just PNR, were protected.
PNR doesn't even protect you from normal fare increases. Only ticketed passengers are guaranteed fares. A skilled TA can easily create and hold a PNR for weeks without ticketing. You don't have a contract and are not protected in this case until ticketed.
