3701 is a bad example to compare Comair 5191 to as there were no passengers aboard the crash of 3701.
That doesn't negate the fact that Pinnacle had two pilots who unsuccessfully tried to exceed the performance limits of the aircraft. The NTSB reported that this practice occurred frequently among the pilot group and those who succeeded were part of the "FL 410 group". There were contributing factors to the Comair accident and it was truly a horrible accident. Pinnacle 3701 occurred due to utmost stupidity of both pilots. One of the pilots was one of my fellow alumni and I know he was taught against that kind of behavior. Pinnacle had to impose a max operating altitude of 37,000 ft to prevent their pilots from trying g this stunt again.
