Got a ticket for 23109 in CA (entering into a speed competition) by CHP. Zero drugs or alcohol involved. Plea deal had the charge reduced to a 23109b, and a misdemeanor conviction. 7 years later had the case EXPUNGED by the court and DA. Applied for GE, got to the interview stage brought all the court documents. Went well, agent was pleasant and put the CBP sticker in the back of my passport and showed me how to use the machine and said I was approved. Driving home got the email that I was denied. Reason was the misdemeanor and they clearly stated that they DO NOT accept expungements. Went on to state that I would be eligible in 10 yrs. YMMV
