I have the same problem with the 4S I received last week. If I get a replacement from the Apple store, will I get a brand new unit or a refurbished phone? If I'm going to get a refurbished phone (Verizon is still backordered by weeks), I might as well return it to Verizon and downgrade to the iPhone 4. Battery life still sucks with 5.0.1 anyway.
I returned mine back to the office, and I should get the replacement in a few days.
If you return to the Apple store, you generally get a refurbished unit.
