Airline code-share agreements

I understand that the code-share agreement between UA and LH requires the booking agent to notify the passenger that the flight will be operated by a different airline and obtain their consent. How is this enforced? What recourse do passengers have when this is not done? We had reservations on a LH flight and were dumped on a UA cattlecar on arrival at FRA.
