Passenger Seeks $540k For Dodgy Seat on Virgin Australia Flight
Complementary drinks? Flight voucher? 5,000 miles? No, no, and no.
Mr. Daniel Gleeson has filed suit against Virgin Australia and is looking for $540,463 in damages. The cause? On a 4.5 hour flight between Sydney and Perth, he reclined his seat and quickly discovered that it could not be righted again.
Mr. Gleeson asserts that he complained to a flight attendant numerous times and asked to be reseated, but was told that the flight was full so his request couldn't be granted. His suit claims that his being forced to sit in an "unsupported position" caused permanent injury to his back.
Virgin Australia denies that the seat was faulty and also denies that Mr. Gleeson was prevent from sitting in any of the 8 free seats in economy.

Maybe it's just me, but I think that a 4.5 hour flight is prefect for a good nap in a reclined seat.

But, what does your ambula- er, aggressive attorney think?
Most of us would spy a working seat and just move ourselves, notifying the FA about the broken seat, I suspect.

I had an always reclined seat twice flying CA for a 5 hour flight. Both times, the passenger behind me complained incessantly and the FAs tried to get me to upright the seat (obviously I couldn't). Funny part each time a different FA came around to tell me upright the seat.
Mmmm.... maybe I should sue too!

My favourite part is that he's a truckie. A guy who spends his whole life sitting in a seat for many hours at a time. And yet somehow his back gives out after 4.5 hours in a comfortably-reclined economy seat?
No no, wait, my favourite part is that this was already a pre-existing condition which he complained about, and that he was travelling with his wife with whom he could have swapped seats at any time.
