Woman arrested at ABIA after refusing enhanced pat down

by JIM BERGAMO / KVUE News
Posted on December 22, 2010 at 9:38 PM

Early Wednesday morning, a computer glitch shut down a security checkpoint for a couple of hours at Austin Bergstrom International Airport. The line snaked out the door as many travelers waited for more than an hour and some missed their flights. One of the first people in line after that shutdown never made it through. She was arrested and banned from the airport.
What's disturbing is this apparently took place in front of three LEOs. What the hell?!

Anyone have any 411 as to whether Ms. Hirschkind is being threatened with a fine? I'll be the first to donate if so.

Uh-oh! She won't pleasant for her Christmas trip. She will banned from airports but, why? She have absolutely no reasons why she has happened at AUS today. She doesn't want to get through the MMW or backscatters machines. TSA have no rights to put her into the body scanners at all.

Good Riddance to TSA!!

I can't quite figure out what happened, after viewing the video. She apparently "set off an alarm"? What kind of alarm? She says she can't go through the AIT due to a "pacemaker like device."

Will keep eyes peeled for the followup. Here's hoping someone gets hold of her with the contact info for EPIC and ACLU.

Poor woman. Good for her for standing up, though.

Nice of the Austin airport spokesperson to give passengers the option of opting out and not flying after activating a security alarm.

wow.

When Hirschkind refused, she says that "the police actually pushed me to the floor, (and) handcuffed me. I was crying by then. "They drug me 25 yards across the floor in front of the whole security."
Was that really necessary? I feel very sorry for the experience that she had to go through.. TSA, perhaps this is why people from other countries aren't visiting the US.

"I understand her side of it, and their side as well, but it is for our protection so I have no problems with it," said Gwen Washington, who lives in Killeen.

"It's unfortunate that that happened and she didn't get to fly home, but it makes me feel a little safer," said Emily Protine.

The TSA did release a statement Wednesday that said in part, "Our officers are trained to treat all passengers with dignity and respect ... Security is not optional."
bull $#%!

I wonder what she was arrested for? Refusing screening isn't a criminal offense. Maybe she was arrested for something imaginative, like disturbing the peace, or trespassing, or something equally inane.

The LEOs definitely share culpability for this event. Their reported actions definitely are over the top. From now on whenvever I see a LEO in an airport, I'll have to ask "Do I trust them?"

Was she even charged with a crime?

Good question. Here's' another one: Why was she handcuffed? Was she that much of a threat to the three police officers?

TSA having Austin airport police do their dirty work

Not just in front of, but at the hands of. Once again, we see local police brought in to enforce TSA's unwritten rules and/or punish people who stand up for their rights.

"I turned to the police officer and said, 'I have given no due cause to give up my constitutional rights. You can wand me,'" and they said, 'No, you have to do this,'" she said.

Hirschkind agreed to the pat down, but on one condition.

"I told them, 'No, I'm not going to have my breasts felt,' and she said, 'Yes, you are,'" said Hirschkind.

When Hirschkind refused, she says that "the police actually pushed me to the floor, (and) handcuffed me. I was crying by then. "They drug me 25 yards across the floor in front of the whole security."

What crime did she commit?

So much for "persons refusing the pat down will be denied access to the secure area and escorted from the airport". This takes it to a whole new level.

I suspect this could trigger 4th Amendment concerns if the arrest was solely related to the search and not to something else she did.

I'm guessing she wasn't arrested for refusing the scan, and that she was arrested for how she reacted while refusing the scan.

If she was dangerous in her refusal, then off she goes.

If she was not dangerous in her refusal... time to prepare some more popcorn.

Isn't this the airport where the Airport Commission make a formal request to the City Council to not allow AIT there? That implies that they don't have them and that this was a WTMD opt-out due to pacemaker.

Here's a link:

http://www.kvue.com/home/Woman-arres...112354199.html

The worst behavior in the entire incident are the words of these two foul wenches:

"I understand her side of it, and their side as well, but it is for our protection so I have no problems with it," said Gwen Washington, who lives in Killeen.

"It's unfortunate that that happened and she didn't get to fly home, but it makes me feel a little safer," said Emily Protine

If I knew Gwen Washington and Emily Protine, I'd shun them until they apologized to the victim on bended knee. Their words display a callousness and selfishness that makes them unfit for most types of human relationships.

For another woman to actually want to see this type of abuse and torment visited on other is deeply disturbing. They are both utterly depraved.
