Japanese space tourist bumped from flight, sues for refund

Japanese businessman is suing for return of $21 million paid for a flight to the international space station. He was pulled from training, presumably because of a medical condition (kidney stones). He believes the real reason was so that a company investor could take his place.

Do you think he deserves any compensation? What are the VDB rules in this situation?

DOT bumping rules don't apply, so it boils down to the contract of carriage.
