Question about EU cancellation rules.
 
I have a question about the specifics about some of the EU rules regarding the cancellation of flights.

I have a flight with Zoom scheduled for the 14 of May. LGW-YHZ. This was to be the first flight of the year on a seasonal service. I've just found out that they've cancelled that flight and won't start the season until May 24. I know that as we've been told well before 14 days that there's no compensation, but I'm wondering about the re-routing part of the regulations.

The airline has offered us a (no charge:rolleyes:) change to the 24th or to another Canadian city "around" the 14th - or a full refund. These options aren't great. My question concerns the wording of the rules. It says they must offer "re-routing, under comparable transport conditions, to their
final destination at the earliest opportunity."

Does that mean the earliest opportunity for the Airline (their next flight- not until the 24th) or the passenger (a flight on another airline?)

This is another area in which the regulations are vague. Generally, the courts will sympathise with the Pax, so I would be tempted to push the point and press for re-routing, or an alternative direct flight, on the date you want.

If it's no dice, then I would reach for the County Court.

NB - if they do offer to fly you to another area, they have to transport you to your original destination:


When, in the case where a town, city or region is served
by several airports, an operating air carrier offers a passenger a
flight to an airport alternative to that for which the booking
was made, the operating air carrier shall bear the cost of trans-
ferring the passenger from that alternative airport either to that
for which the booking was made, or to another close-by desti-
nation agreed with the passenger.
