In California, resistance to an unlawful arrest is not in violation of those Penal Code sections. If excessive force is used by an LEO to make an arrest, the person being arrested is entitled to use reasonable force in self-defense (People v. Curtis, 70 Cal.2d 347).

US Airways spokeswoman Valerie Wunder confirmed she'd received the photo before last week's incident in San Francisco and had spoken to Tarlow, but said employees had been correct not to ask the man to cover himself.

This dude gets popped for saggy pants.. (yeah they say it was his failure to comply and not the pants) but it was the pants that started it all....

yet there is another guy that repeatedly flies in womens lingerie and nothing else, and they allow him to do it!!!!


I'm sorry but the dude in drag would be more unpleasant to look at while locked in an airplane than a guy with saggy pants (that you really can't even see since he's SITTING DOWN!)

SAN FRANCISCO (KGO) -- ABC7 has learned the San Mateo County district attorney has decided not to file charges against a Bay Area college student arrested after allegedly refusing to pull up his pants as he boarded a flight at San Francisco International Airport.

Tuesday afternoon, Supervisor Malia Cohen introduced a resolution calling for the FAA to investigate the incident. She is also asking the airline to implement a uniform dress code for its passengers to prevent future incidents.

Why just a dress code for US Air? Why not a dress code for every carrier that flies out of SFO? The TSA can check that we're appropriately attired before we get through the checkpoint.

After listening to the incident that was caught on tape, I'm not really sure if the guy was in a mental state to understand the situation. He kept repeating things and did not directly acknowledge what was said to him. For awhile, he just kept repeating, "Sir. Yes, Sir. Sir. Yes, Sir," or something like that, almost like he was mocking them. Maybe he was just emotionally distraught after attending his friend's funeral, but if that was the case, he wasn't emotionally ready to be in a public place, unfortunately.
