BA First Helicopter Ride - QC [Quebec, Canada] Lawsuit

Posted without comment. Decision on BA’s motion to dismiss and transfer to other jurisdiction. Both motions denied and case will proceed to trial.

Factual basis is international tariff (Canada or USA) includes provision that free helicopter ride given to First Class passengers arriving at JFK. Agreed facts are that plaintiff (myself) requested service and was denied.

Thank God there are no statements in the “international tariff” regarding the provision of clean seats. We could all sue for a lifetime supply of wet wipes.

Unconvinced the lack of clarity of the location is a big deal, since it could be easily figured out by clicking on the link. And “QC” is the common notation for the province, though I appreciate it could be confusing in an international context. Certainly something to consider for the future. As to my personal interest, I’ve updated the OP previously to make that clear.

Have I entered a parallel universe here. Where does it say that helicopter transfers are included for F passengers? This service was demised long ago. I took it in the mid 90s.

The DOT doesn’t post tariffs online, unfortunately. However, here is the rule showing as valid on the date of travel. This was received directly from the DOT.
