Compensation for delayed flight
 
Morning guys - I *think* this is the right place.
I booked with BA LGW-DUB-BDL on 16/12/23 (at the time didn't know this was an aer lingus code share)
All economy seats, full booking costs 2620.08 (I don't have the GPB symbol on my US keyboard!)
LGW-DUB (BA5903) was delayed causing a missed connection DUB-BDL (BA6163)
They put us on DUB-BOS then bussed us to BDL, we arrived at BDL ~10 hours late. Was a nightmare flight as it was me + 3 kids (9/6/6/), they spread all of us all over the place & also got us there late.

The BA guys sent me over this way... Does anyone know how to pursue this (EL are not really responsive) and also what numbers I should be looking at? Thanks in advance!

That's a straight EC261 claim for delay, 600 euro per adult, assuming the LGW-DUB sector was not an exceptional delay i.e. NATS and its understaffing

Rerouting via BOS and bus was appropriate as the alternative would have been a overnight stay in Dublin, or possibly several nights

Its €600 for all passengers, age doesn't matter

+4 hours
+3500km
= type 3

=> €600 per passenger impacted

As you probably know the only flight from Europe to BDL is with EI, so no real options other than BOS

Apparently not due anything due to "PAX CHECK IN ERROR" - anyone seen this before?

So... it looks like EI are trying to say only EI233 is eligible.. and they're only paying out 880 in compensation?

I've checked my timings and we finally arrived at BDL at 2158 (google maps timestamp) where we were meant to arrive at 1630... I think I'm right in saying it should still stand as 4x 600 = 2400... right?

did you click the "+" button on the form, and add in the flight details not only of the delayed flight (LGW-DUB), BUT ALSO of the flight you missed (DUB-BDL)?

Because it seems they have ignored/missed the fact that you missed a flight to BDL and were instead rebooked to BOS, I'm just wondering if the form was filled in correctly so that they know this salient detail. If there's any chance that the form was submitted (even inadvertently) only referring to a LGW-DUB trip, then this might explain why a lower amount was offered. (Please always specify the currency - 880 what, exactly? Total, for 4 people?)

Just to be pedantic, your trip falls outside the scope of EC261/2004 because neither the origin or destination of your ticket is in a country covered by this regulation (and tickets that only connect in the territory of a member state - such as your Aer Lingus ticket connecting in DUB - are not covered by Regulation EC261/2004). Instead, you are covered by the corresponding so-called "UK261" which is the UK's transposed version into its own law. The amount you should be refunded under this regulation should therefore be specified in UK£ and it is no longer the case that each pax is entitled to €600, but rather whatever the transposed UK regulation states (£520 per pax, according to this)

EDIT:

880, if GBP, is equal to 4 times £220 - the amount required for "short" flights.

It does indeed seem that you are being compensated for an LGW-DUB trip rather than for an LGW-BDL trip.

Hi - I genuinely appreciate the time take for the full expansions! Annoyingly I'm on a US laptop so have no pund symbol (or not what we would call a pound anyway!).

Your assessment is correct, they've offered GBP 880.00 as full and final, however on the original form I absolutely submitted both legs. With this ant the initial "PAX ERROR", I think it's them either not knowing what to do, or worse trying to avoid/ delay.

Having the full "It should be X" is incredibly helpful, many thanks again! (Will update when they stop being silly!)

As a brief "no update" update. I've had a further 2 response stating:
"We have processed a bank transfer in the amount of GBP880.00 on January 17th, the process takes between 7-10 business days to be available in your bank account."

Completely ignoring my request for the calculation/ confirmation that they've actually read my entire plan.

Anyone know the escalation process on this? As always, thanks in advance!

It's interesting, because I was once disrupted on a BA itinerary, which was DUB-LHR-HND. BA cancelled their DUB-LHR which ended up in major disruption and I spent two nights in hotels before being sent on my way. I also only received the compensation of €250 (over an above my hotel receipts etc) for the cancelled short-haul flight instead of €600, despite pushing back on it. There might well be some arcane rule they can get away with in certain circumstances.

If you wish to escalate, I would probably reply back stating you wish to speak to a supervisor or Manager about it, perhaps.

Social media usually catches their eye so a post on X complaining often generates a reply link.

A mate of mine is currently playing ping pong with them for a valid EU261 claim and they came back saying they couldn't find their booking even though they were provided the EI.COM booking reference with ticket number and a screenshot of the confirmation and boarding card! We cant work out if its actual stupidity or deliberate.

I'd say this is a process that's fallen over rather than intentional incompetence.

Registered letter in the post to head office in Dublin probably the next step, and make it clear that whilst you acknowledge receipt of £880, you consider this to be a payment on account only and do not accept it in settlement.
