That's the twist in the story to make it more interesting. Does DL have a duty to police the business class cabin? Does it matter even if it does have a duty since a passenger in business could have just as easily taken the photos. Is what could have happened important or is what actually happened important?

Now you know why lawyers are they way they are....they get professors asking these kinds of questions in law school.
