It's like bank charges. Things will only change if people take action. If people take action in sufficient numbers eventually there will be a test case and the law will be clarified.
There are currently four cases pending before the European Court of Justice:
1) Kramme v SAS (technical problems and extraordinary circumstances)
2) Wallentin-Herman v Alitalia (technical problems and extraordinary circumstances)
3) Sturgeon v Condor (distinction between cancellation and delay)
4) Böck v Air France (distinction between cancellation and delay - technical problems and extraordinary circumstances)
There is also a fifth one involving Emirates but this one is bound to be dismissed quite easily as falling outside the scope of the Reg.
