That was wording used when tickets went on sale last July before the DOT had given VA their final authority/certificate. Looks like somehow it may have gotten stuck in your email. I wouldn't worry...they've been flying the service for the last 8 months, if they weren't allowed to, I'm pretty sure someone would have caught them by now :-).
