I must be dense, but I really don't see how the bolded part of your post has any bearing on the amount of compensation, if any, due to you. As in, how does the (possible) price of an upgrade from Executive Economy to Business class have any relevance on your loss?
I understand that you are (probably quite rightly) due compensation for your increased transportation costs to go from EWR to JFK. As for anything else, however, I just don't see it, and I really don't understand how you calculate your loss.
