The CAA does not define "drunk" for a passenger, therefore, most prosecutions would fail on that point of interpretation. I would imagine it would come under existing legislation where by any Police Officer is given the status of an expert witness where they are allowed to say if someone is drunk or not. So if you've been drinking Diet Coke with something else in it, I'll be able to tell.
