If you look more closely at my posts on EU Compo, you will actually see that I have been a vociferous critic of BA's various attempts to wriggle out of paying proper compensation when it is due to pax under 261/2004. However, it is in nobody's interests for the rights under the regulation to be misrepresented and misunderstood.

In this very thread someone has misunderstood the right to compo for a flight delay 5hrs+. As has been correctly pointed out, the right in that instance is to abandon the journey and receive a refund, not compensation, and it clearly only applies if the journey has been abandoned (which is not the case here).

As for service recovery, I think Wobbly Wings can probably work out for him/herself that it might be worth his/her while writing in to BA, but s/he specifically asked about compensation. This coupled with the reference to threatened court proceedings indicates that s/he wanted to know about entitlement to compensation rather than ex gratia.

lorraflites, do let me know when you manage to get a court to award you an ex gratia payment
