If the pax was not a FIRST pax, it would have been perfectly correct to inform the crew of this. Pax on the floor is also a health and safety issue. I know many a pax (particularly on their way to/from Oz) who would like to lie on the floor in Y in between the seats who have been told they cannot do this for safety reasons.
