True but doesn't necessarily mean you're off the hook if you're bringing it back to your home country where the price tag you paid exceeded your duty free exemption amount!
Or if you live in NY where you're legally obligated to report and pay tax on purchases made outside NY. In theory they can reference customs docs to make sure that you are also paying the Sales & Use tax. Or you could lie on your customs form, which is probably a bad idea.
