Since people are routinely scolded for trying to sell their miles and that is only breaking the rules, I think breaking the law is worse.

This particular law varies in severity quite a bit from state to state. In some states, it's a joke and rarely enforced, others a summons is issued, and others you go to JAIL and have to post bail.
