I think there is a genuine point however when BA manages the resulting slot constraints by cancelling services on a commercial basis. During the time in question BA maintained 100% of its L/H service, but slashed domestic and shorthaul routes for commercial reasons (i.e. to maximise the yield from the limited slots available). The EU Regs are meant to cover the cancellation fo flights for commercial reasons, it seems the OP would have a good case to me.
BA's counter-argument, surely, would be that cancelling L/H flights is far more disruptive to people than cancelling S/H flights which is why they take that approach. I see your point and it may be right, but trying to prove it would be much harder I imagine.
