Just to add to feedback already posted, it might be useful to note that the rights you quoted from BA.com were recently amended. When I last had cause to look them up, a good 14 months ago, they were significantly less lenient - part 3e, if it was even written into the CoC at the time bared little resemblance in words or spirit back then. The change came to my attention only a few weeks ago thanks to another poster who brought it to light here a few weeks ago.
I'm a bit confused by this, because the BA website says the CoC were effective 1 March 2005 (

Also, I have found this press release from the Office of Fair Trading which states that BA were forced to amend their CoC in 2003 to introduce a provision such as this, to comply with the Unfair Terms in Consumer Contracts Regulation:

I don't know from your post if BA denied you a similar claim 14 months ago, but if they did they could have been acting in breach of these Regulations.
