I have had the MP Visa for 4 years now, have always had some-level of MP elite status, and have always been assessed the annual fee. When I have contacted First USA about waiving it, they refuse to do so because of the benefits received (MP miles).

If you have any success in getting the fee waived please let us know. I am sure that there are many FTers out there who would love to follow suit.
