Yes, and thanks for making my point that I unclearly made earlier, "money talks and BS walks". I totally agree with your law lesson above.
I'm sure the great legal minds at Marriott, et al, placed many options, contingencies and "outs" in the contract (which are generally one sided in favor of the house in my experience). But it might have cost them money in lost revenues and penalties. So when it came to this event vs. Marriott's new smoking policy, did money or its new policy prevail?
