a suggestion

The first time the flight attendant needs to remind a passenger it could be an oversight. If it happens again why couldn't/shouldn't the flight attendant take possession of the phone until landing to make sure it stays off ? Seemed like a small price to pay for safety and every leaves the passenger next to the offending person from being responsible.
