We have to be clear which one we're answering. The OP asked "can," not "may." If everyone at all the employers/clients is ethical, knows the laws, and follows them, hopefully they won't do anything they're not supposed to. At that point "may" comes into play, but we can't be sure of that.
I'm addressing it as a legal/ethical question.

Unless they signed an agreement allowing their consent or subject to a search warrant, an employer should not be.
