They just sometimes choose not to so that they can dedicate their resources to what they consdier more agregious infractions.

The union can file a grievance and represent the FA at a hearing or an arbitration, but if the case holds water, even the System Board of Adjustment is unlikely to overturn a termination for something the FA shouldn't have been doing in the first place (provided the company followed investigation and discipline procedures correctly).
I would guess its one of those things that "just not that easy". Luckys right, because nothing will happen once the FA denies it, unless the pax just happen to be recording the exchange it will never be proven and thus the union will back the FA and nothing will happen.

As to it being a resource problem, probably, UA just doesnt feel it has the manpower or the $ to waste fighting it. I would guess its a bit easier than this being a corporation but probably not too far off the mark: http://cgood.org/assets/attachments/firing_chart.pdf
