If you say that the aircraft was on pushback with the radome truly installed upside down, then there is the precedent for criminal prosecution on the groundstaff and Union, as well as negligence on the part of the flight crew.
Since the 757 nose is particularly short and deflects steeply, I wouldn't ever be able to not see what's going on there unless I was wearing an instrument hood, so there's no good reason that the drivers wouldn't keep the plane from departing if the radome was not properly installed.
