Thanks for your input. It became clear that you folks did not understand what sort of case this is or how it worked. I honestly was trying to shed some light upon that. No i am no legal theoritician but i do have some practical experiences. Unfortunately I allowed some attacks upon my integrity (Skeptisism as to why i brought this and how much i expect) get under my skin.

You are correct, the facts are important. The question that some have hammered away at me is that the facts as I understand them and as is asserrted do (in the minds of some) not warrant proof. They may or may not, but to the extent they will, that will be determined in the Discovery Phase.

Saint has his position as do I have mine. We'll just see who has a pat hand. Anyway, one of these days I really want to get back to your country to see where my fore fathers came from. (so long ago). I have a fantacy that i walk into some pub in Cornwall, and meet some people with the same family name. It would be a hoot.

Please understand that i really did not want to do this, but the failure of BA to do anything much less make restitution for the items destroyed, left me no alternative.
