Not all Y fares are refundable. I haven't seen many non refundable ones, but they may exsist. Also, some Y fares may also be advance fares as well, such as a 7 day advance purchase fare.
I haven't ever seen a non-refundable Y fare, but I'll take your word for it.
You can achieve the same work-around by logging into continental.com with your OnePass number before buying a Y-up fare; if the Y fare is, indeed, non-refundable and upgrade inventory is not forthcoming, you can use the 24 hour cancellation policy to cancel without penalty and book again.
