Theoretically, citizens have an absolute right to enter the US, with or without a passport.

But, I suspect, this is a right the government chooses not to recognize. And, I doubt the Supreme Court is going to help you out.

Why can't you just renew the passport. As I understand it, the renewal crisis is only in the US. Overseas you should be able to get a speedy renewal.
