The recipient is not actually eligible and as i said earlier if they see you changing your address to match another account and then changing it back again is that not enough for them to go on?

How do you know the recipient mentioned in the OP is not actually eligible for a transfer of points by Starwood or Starwood agent? Unless you know it to be a barter or sale, you have nothing to go on to claim that the recipient is not actually eligible for a transfer without violating the SPG T&Cs.
Changing addresses, like transfers, per se does not constitute a violation of the SPG T&Cs. (Also, awards and points are not the same thing.)
As I said earlier,
eligible recipients for transfer of points include the persons named on accounts who share the same residential mailing address at the time of point transfers performed by Starwood or a Starwood agent.
There's no violation of SPG T&Cs unless Starwood redefines and revises the T&Cs.
