There is no legal right to use pot in Holland. What you have is a peculiar Dutch invention called a tolerance policy. The law still classifies pot as an illicit drug but the policy is to allow certain types of possession, trade, and use - and prosecutions are discouraged but pot can be confiscated (even small amounts).

However, the level of tolerance can bet set by each municipality (town) and some towns still make any type of possession a criminal offence that can (and sometimes is) prosecuted.
