What happens in a case like that is...
The crew gets his i.d. and fills out a report
The report goes to the FAA
The FAA puts his name in a database of "offenders"
The FAA also sends him a letter and tells him there will be legal action against him. I don't know how this part is worked out, but he is then fined up to $10,000. I don't know how they decide on how severe the fine is though. If it was a 1st offense and he was relatively compliant about putting it out then I suppose the fine is not as great.
If he does it again, he will be fined the maximum penalty.
