That's correct. However there are ways to sue for harassment, though I doubt that this would qualify. I hate to admit it, but back in '94 a woman in CVG nailed us for 10 calls in the middle of the night every night. It took her a few days to get the phone company to track it back to one of our IVRs' fax. As soon as I heard what happened, we put a permanent logic change in to limit tries to three times within 5 minutes and never fax out after 10:00PM EST. It was a small pain for the business, but a huge legal protection. Also, I do place myself in other people's shoes and I would have gone ballistic if I were on the receiving end of those calls!
