Thats your choice. I prefer to stick with the actual legal definitions. I'm sorry you had such a bad experience, but further discussion is futile when emotions override logic. This point has been discussed at length, to no avail. If once presented, the evidence and facts are ignored, then there is no further use in trying to reason. I once heard a government employee tell a joke about a priest and a duck....guess I should sue him for violation of church and state rules...not to mention using fowl language in my presence.
