Under this scenario, it is possible if the fa's are all lineholders going into their days off, then they might waive their legalities in order to get home. If a fa is on reserve w/ multiple days of availibility left, there is no motivation for that fa to waive.

As for the one fa who wants to abide by the contract (that AFA and UAL agreed to) as long as you have the FAA min to work the flight, they would probably leave that fa behind.

UAL tracks the # of times a particular legality is waived, so when contract time comes around, they can claim that it is not needed. Therefore, they are not waived that often.
